Alternative Dispute Resolution

Not every dispute needs to be resolved in court. At Sowa & Partners, we have extensive experience in mediation and arbitration, helping clients resolve disputes efficiently and professionally.

Mediation

The lawyers at Sowa & Partners conduct mediations in civil and commercial matters and also represent parties participating in mediation proceedings.

We act both in cases where the parties have been referred to mediation by a court or arbitration tribunal and where they have voluntarily agreed to participate in mediation conducted by one of our mediators.

Throughout the mediation process, we remain strictly impartial and ensure the confidentiality required under the Code of Civil Procedure. We facilitate communication and negotiations between the parties, helping them work towards a mutually acceptable solution.

Mediations may be conducted either in person or online.

Attorney-at-law Tomasz Sowa is registered on the list of permanent mediators maintained by the District Court in Warsaw.

Examples of disputes that can be tried to be resolved through mediation:

disputes concerning the implementation of IT systems,
delays in construction projects,
disputes concerning the quality or proper performance of construction works,
conflicts between shareholders or partners in commercial companies,
claims relating to the sale of defective production machinery,
disputes concerning the proper performance of services,
infringements of personal rights,
infringements of intellectual property rights.
I do not believe that every dispute can be resolved through mediation. I am convinced, however, that mediation can help resolve even disputes that initially appear to have no prospect of an amicable settlement. Years of conflict and a complete breakdown in communication can sometimes be overcome once the parties are given the opportunity to speak openly and begin communicating again.

Arbitration

The lawyers at Sowa & Partners represent clients in arbitration proceedings and also act as arbitrators.
